NG Sites Real Estate Addendum
This Real Estate Addendum ("Addendum") is part of the NG Sites Terms of Service ("Terms") for every Customer who subscribes to the NG Sites Real Estate plan. You accept it together with the Terms at checkout. Words defined in the Terms mean the same here. Where this Addendum and the Terms conflict on a subject this Addendum covers, this Addendum controls.
1. Who the Real Estate plan is for
The Real Estate plan is for real estate licensees of the California Department of Real Estate ("DRE"), such as agents, brokers, and their teams, who use the website to advertise their real estate services in California. It does not support licenses issued by other states. You confirm that you hold an active California real estate license, that the DRE license number you gave us is yours, and that your responsible broker allows the website where your license or your brokerage requires it. Do not use the website to advertise real estate services where you are not licensed to provide them.
We are not a real estate broker and take no part in any transaction. We do not refer clients, take referral fees, or share in commissions.
2. Licensing and advertising rules
Your website is advertising for your real estate services, and you are responsible for its compliance with the advertising rules of your license, including the California Business and Professions Code and the regulations of the DRE. In particular:
- your website shows your name as it is licensed, your DRE license number, and your responsible broker's identity. The website shows the license number and the brokerage you gave us on every page; you keep them correct and visible;
- as the brokerage, you give the name under which your responsible broker is licensed by the DRE, not a nickname or a name the DRE has not licensed;
- your license number appears in type no smaller than the smallest type on the page. If it appears smaller anywhere on your website, tell us so we can fix it;
- your website makes clear that you are a licensee, with a term such as "agent," "broker," or "licensee." Use "REALTOR®" only if you are a member of the National Association of REALTORS®;
- if you advertise under a team name, the name includes the surname of at least one licensed member of the team, does not use a word such as "broker" or "brokerage" that suggests the team is a brokerage of its own, and appears with your responsible broker's identity as the law requires;
- you do not advertise services you are not licensed to provide, or a status or designation you do not hold;
- statements about yourself, your results, listings, prices, and reviews are true and not misleading.
3. Fair housing
You will not publish content that indicates any preference, limitation, or discrimination based on a characteristic protected by the federal Fair Housing Act, the California Fair Employment and Housing Act, the Unruh Civil Rights Act, or other law that applies. These include race, color, religion, sex, gender, gender identity, gender expression, sexual orientation, marital status, national origin, ancestry, familial status, source of income, disability, veteran or military status, and genetic information. This applies to every page, listing, community page, blog post, and image, and to text an AI assistant writes for you. In particular:
- Steering. Do not steer anyone toward or away from a home, a neighborhood, or a community because of a protected characteristic, and do not suggest which people a place suits.
- Community pages. Describe the homes, the amenities, the services, and the area's features, not the people who live there or who would fit in.
- Advertising audiences. If you advertise your website or your listings, including with a Meta Pixel or a Google tag you add to the website, do not choose or exclude an audience by a protected characteristic or by a stand-in for one, such as ZIP codes chosen to leave a group out. Use the housing ad category or settings where the platform offers them, and follow its housing ad rules.
- AI-written content. Content an AI assistant writes for your website is your content, and you are responsible for it as if you wrote it. Review it for these rules before you publish it.
- Equal Housing Opportunity. Show the Equal Housing Opportunity logo or statement where the law, your MLS, or your brokerage requires it.
4. Contacting leads
Your website's forms collect inquiries from visitors (leads), which you read in the Admin. You decide how to follow up, and you are responsible for doing it lawfully, including:
- getting the consent the Telephone Consumer Protection Act and state law require before you call or text a lead with an automatic telephone dialing system, an artificial or prerecorded voice, or marketing text messages, and honoring the National Do Not Call Registry;
- honoring a request to stop, made in any reasonable way, such as replying "STOP" to a text;
- following the CAN-SPAM Act and state law for marketing emails, including to other agents and businesses, since the Act has no exception for business-to-business email;
- keeping any consent text on your forms accurate for how you actually contact leads. The consent text a new website starts with says that calls and texts may use automated technology, that consent is not a condition of any purchase, and that the visitor can opt out. It is a template, not legal advice. The website records whether a visitor ticked the box and the consent text shown to them.
5. Listings, photos, and MLS data
You publish a listing only with the authority to market the property, and you keep its details accurate and current. You confirm that you have the rights to every photo, video, floor plan, and description you publish, whether you took it yourself, licensed it from a photographer, or received it from a seller. A photographer's license may forbid using a photo after the listing ends; you follow it.
We do not provide an IDX or MLS feed. Content from a multiple listing service (MLS) is yours to license, and may be published only as its rules and your participation agreement allow, including any attribution, display, and update requirements. If a rights holder or an MLS asks for content to be removed, you remove it promptly, and we may remove it under the Terms.
The sample listings, communities, reviews, and posts your website starts with are drafts for illustration. Replace or delete them before you publish; never publish a sample as if it were real.
6. Reviews and testimonials
You publish only genuine reviews and testimonials from real clients who had the experience they describe, with their permission. In particular, you do not:
- publish a review or testimonial that is made up, written by AI, or written by someone who did not have that experience with you;
- edit a review in a way that changes its meaning;
- offer anything in return for a review that must be positive or negative;
- publish, without a clear disclosure, a review by yourself, your team, your brokerage, your employees, or your relatives;
- leave out negative reviews while presenting the rest as all, or most, of the reviews you received.
A review or testimonial discloses any payment, gift, or business, family, or personal relationship between you and its author.
